Overview of Cannabis Legalization in New York

New York legalized recreational cannabis in March 2021 through the Marijuana Regulation and Taxation Act (MRTA). The law allows adults 21 and older to legally possess and use cannabis for personal enjoyment. Before this law, only medical marijuanas in New York was permitted under a tightly regulated system.

Legalizing weed in New York City and across the state also created a regulated market for licensed dispensaries, growers, and manufacturers. The Office of Cannabis Management (OCM) oversees this system.

Yes, recreational weed is legal in New York for adults aged 21 and older. You can legally purchase cannabis at any licensed New York dispensary, and you’re also allowed to carry a personal amount within the legal limits.

Is THC Legal in New York?

Yes. THC is legal in New York in products sold through licensed dispensaries. That includes THC-rich flower, edibles, concentrates, and vape cartridges. However, unregulated or black-market products are still illegal and may be unsafe.

Growing Weed in New York

Adults 21 and over can legally grow weed in New York, but home cultivation is subject to specific rules. As of now, medical marijuana patients can grow up to six plants (three mature, three immature). Recreational users will be allowed to cultivate under similar rules once final regulations are implemented—likely within the next year.

Growing weed in New York must be done in private residences, out of public view, and with proper security measures in place.

Possession and Storage Limits

According to current weed laws in New York:

Adults can legally possess up to 3 ounces of cannabis flower

You may also store up to 24 grams of cannabis concentrate
